Terms of Use

1. Acceptance of Terms

By downloading, installing, or using Nurly ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms apply to all users of the App, including individual users and family members who access shared family data.

2. Description of Service

Nurly is a baby tracking application designed to help parents and caregivers monitor and record baby care activities, including:

• Feeding tracking (breastfeeding, bottle feeding, solid foods)
• Sleep and nap logging
• Diaper change recording
• Growth measurements (weight, length, head circumference)
• Activity timing (tummy time, baths, etc.)
• Health records (vaccines, medications, appointments)
• Milestones and notes

The App also offers optional Family Sync functionality that allows multiple caregivers to share and synchronize baby data across devices.

3. Medical Disclaimer

You should:

• Always consult with qualified healthcare providers for medical concerns about your baby
• Not rely solely on the App for health-related decisions
• Seek immediate medical attention for any health emergencies
• Use growth charts and statistics as general references only, not as diagnostic tools

Nurly's tracking features, statistics, and any generated reports are meant to supplement — not replace — professional medical advice and regular pediatric care.

4. User Accounts and Family Sync

4.1 Account Creation

Nurly uses anonymous authentication. You do not need to provide an email address or create a traditional account. When you enable Family Sync, your device is assigned an anonymous identifier to enable synchronization.

4.2 Family Structure

Family Sync organizes users into family groups with the following roles. Each family can have up to 6 total members (1 owner + 1 parent + 4 caregivers):

• Owner: The user who creates the family. Has full control over family settings, membership, and subscription.
• Parent: Can add and manage babies, create and edit all entries, and manage health records.
• Caregiver: Can add entries and edit their own entries. Cannot modify babies or health records.

4.3 Your Responsibilities

You are responsible for:

• Keeping your device secure and preventing unauthorized access to the App
• Only inviting trusted individuals to your family group
• Managing your family membership and removing members who should no longer have access
• Providing accurate information when tracking baby data
• Safeguarding any invite codes you generate

4.4 Invite Codes

Family owners and authorized members can generate invite codes to add new members. You are responsible for sharing these codes only with intended recipients. We are not responsible for unauthorized access resulting from shared invite codes.

5. Subscriptions and Payments

5.1 Free and Premium Features

Nurly offers both free and premium features:

• Free: Local-only tracking for one baby, basic features
• Premium: Family Sync, multi-baby support, custom themes, doctor reports, and additional features

5.2 Subscription Plans

Nurly Premium is available as:

• Monthly subscription: Billed monthly
• Yearly subscription: Billed annually (discounted rate)

5.3 Family Subscription Sharing

When a family Owner subscribes to Premium:

• All family members benefit from Premium features at no additional cost
• If the Owner's subscription expires, Family Sync is suspended for all members
• Family members do not need their own subscriptions

5.4 Billing and Renewal

• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
• You can manage and cancel subscriptions in your Apple ID account settings
• All payments are processed by Apple and subject to the App Store's terms and conditions

5.5 Free Trials

If a free trial is offered, it will automatically convert to a paid subscription unless canceled before the trial ends. You will not be charged during the trial period.

5.6 Refunds

Refunds are handled by Apple according to their refund policies. We do not have the ability to process refunds directly.

6. User Conduct

You agree to:

• Use the App only for its intended purpose of baby tracking
• Provide accurate information when using the App
• Respect the privacy and rights of other family members
• Not use the App for any unlawful purpose
• Not attempt to reverse engineer, modify, or distribute the App
• Not attempt to access other families' data or circumvent security measures
• Not use the App to harass, abuse, or harm others

7. Data and Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we handle your information. By using the App, you consent to the practices described in the Privacy Policy.

7.1 Data Ownership

You retain ownership of the data you enter into the App. We do not claim any ownership rights over your baby tracking data.

7.2 Data Responsibility

You are responsible for:

• Backing up your device regularly (for local data)
• Managing who has access to your family's data
• Understanding that data deletion is permanent

7.3 Data Loss

We are not responsible for data loss due to:

• Device malfunction or loss
• App deletion without backup
• User error or accidental deletion
• Circumstances beyond our control

8. Intellectual Property

The App, including its design, features, functionality, and content, is owned by Nurly and is protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute the App
• Create derivative works based on the App
• Use the App's name, logo, or branding without permission
• Reverse engineer or decompile the App

9. Third-Party Services

The App uses third-party services including:

• Firebase (Google Cloud): For Family Sync data storage and synchronization
• Apple App Store: For app distribution and payment processing

Your use of these services is subject to their respective terms and privacy policies.

10. Limitation of Liability

To the maximum extent permitted by law, Nurly and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data or information
• Health outcomes or medical decisions
• Decisions made based on App data or statistics
• Unauthorized access to family data due to shared invite codes
• Service interruptions or unavailability
• Any other damages arising from the use of the App

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for the App or subscription in the 12 months preceding the claim.

11. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The App will be uninterrupted, error-free, or completely secure
• The App will meet your specific requirements
• Any data or calculations will be accurate
• The App will be compatible with all devices

12. Indemnification

You agree to indemnify and hold harmless Nurly and its developers from any claims, damages, losses, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit through the App

13. Changes to Terms

We may update these Terms of Use from time to time. We will notify you of significant changes by:

• Posting the new Terms on this page
• Updating the "Last updated" date
• Providing notice within the App for material changes

Continued use of the App after changes constitutes acceptance of the new Terms.

14. Termination

14.1 By You

You may stop using the App at any time by uninstalling it. If you have a subscription, you should cancel it through your Apple ID settings.

14.2 By Us

We reserve the right to:

• Terminate or suspend access to the App for violations of these Terms
• Discontinue the App or any feature with reasonable notice
• Remove content that violates these Terms

14.3 Effect of Termination

Upon termination:

• Your right to use the App ceases immediately
• Local data remains on your device (unless you delete the app)
• Cloud data may be deleted according to our data retention policies

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the appropriate courts.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nurly regarding the use of the App and supersede any prior agreements.
