Terms of Use

1. Acceptance of Terms

By downloading, installing, or using Nurly ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

2. Description of Service

Nurly is a baby tracking application that helps parents and caregivers record feedings, sleep, diapers, growth, activities, milestones, notes, and health records such as vaccines, medicines, and appointments for up to ten children. The App also offers an optional Family Sync feature that shares this information with family members and caregivers you invite.

3. Medical Disclaimer

Nurly is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

The information provided by the App, including growth charts, WHO percentile comparisons, statistics, and reminders, is for general informational purposes only and should not be considered medical advice. Always consult a qualified healthcare provider for questions about your child's feeding, sleep, growth, vaccinations, medication, or health.

Reminders are a convenience and may not be delivered if notifications are disabled, the device is off, or the App is removed. Do not rely on the App as the only reminder for medication or medical appointments.

4. User Responsibilities

You agree to:

• Use the App only for its intended purpose
• Provide accurate information when using the App
• Only record information about children you are a parent or caregiver of, or have permission to record
• Keep your device and the App secure
• Not use the App for any unlawful purpose
• Not attempt to reverse engineer, modify, or distribute the App

5. Subscriptions and Payments

Nurly offers an optional subscription ("Nurly Premium") that provides access to premium features such as Family Sync, WHO growth percentiles, doctor reports, data export, unlimited history, and additional themes:

• Monthly subscription: Billed monthly
• Yearly subscription: Billed annually

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in your Apple ID account settings.

Payment is charged to your Apple ID account at confirmation of purchase. All payments are processed by Apple and are subject to the App Store's terms and conditions.

Free trial periods, if offered, will automatically convert to a paid subscription unless canceled before the trial ends.

Within a family, Premium features are provided to members based on the family owner's subscription. If the owner's subscription ends, Family Sync and other premium features become unavailable to the family until it is renewed. No data is deleted when a subscription ends.

6. Intellectual Property

The App, including its content, features, and functionality, is owned by Nurly and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we handle your information. By using the App, you consent to the practices described in the Privacy Policy.

8. Data and Backups

Your data is stored locally on your device by default. We are not responsible for any loss of data due to device malfunction, app deletion, or other circumstances. We recommend regularly backing up your device. Premium includes a data export that you can use to keep your own copy.

9. Family Sync Feature

The Family Sync feature allows you to share your children's information with other people using an invite code. When you use it:

• You control access: Only people you share the invite code with can join your family, and the owner can remove any member at any time
• Roles apply: Parents can edit and manage the family; caregivers can log and view but not delete children or manage members
• Shared responsibility: Every member can see the family's logs and health records, and parents can edit them
• Anonymous identifiers: Members are identified by anonymous identifiers and the display names they choose, not by personal accounts

You are responsible for sharing your invite code only with people you trust. We are not responsible for any consequences of sharing your family's information with others.

10. Limitation of Liability

To the maximum extent permitted by law, Nurly and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data or information
• Personal injury or health consequences
• Missed or late reminders
• Decisions made based on information shown in the App
• Any other damages arising from the use of the App

11. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or completely secure.

12. Changes to Terms

We may update these Terms of Use from time to time. Continued use of the App after changes constitutes acceptance of the new terms. We encourage you to review these terms periodically.

13. Termination

We reserve the right to terminate or suspend access to the App or to Family Sync at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
